These Terms & Conditions govern your use of our website and your purchases from us. Please read them carefully before placing an order. By using the site or placing an order, you agree to these Terms.

“Products”: candles and related items we sell.
“Order”: your request to buy Products from us.
“Consumer”: an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.

3. Scope of these Terms

These Terms apply to your access to and use of the Website and to all sales of Products to Consumers in the United Kingdom. If you purchase as a business, additional or different terms may apply; please contact us first.

4. Using the Website

• You must be at least 18 to place an Order.
• You agree not to misuse the Website (no scraping, hacking, or harmful code).
• We may suspend, withdraw, or restrict the Website for business or operational reasons.

5. Orders & Contract Formation

• Your Order is an offer to buy; we accept only when we email your order confirmation or dispatch notice.
• If we cannot accept your Order (e.g., out of stock, pricing error, failed checks), we’ll refund any payment taken.
• Please check your details carefully; errors can delay fulfilment.

6. Prices, Taxes & Availability

• Prices shown are in GBP and include VAT where applicable.
• Delivery charges are shown at checkout.
• We take reasonable care to ensure prices/availability are accurate but they are subject to change prior to acceptance.

7. Payment

We use [Stripe] to process payments. By submitting payment details, you confirm you are authorised to use the chosen method. We do not store full card numbers. Payment is taken at checkout or on dispatch depending on the method.

8. Delivery

Delivery options and estimates are shown at checkout and in our Shipping Policy. Risk in the Products passes to you on delivery; title passes once we receive full payment. Please provide a complete and accurate address. Undeliverable parcels may be returned to us.

9. Right to Cancel (Consumers)

Under the Consumer Contracts Regulations 2013 you have 14 days from the day after delivery to cancel for any reason. To cancel, notify us at info@neluxcandles.com. You then have 14 days to return the items.

• You are responsible for return postage (use a tracked service).
• We will refund the Product price and the cheapest standard delivery option offered at checkout.
• We may make deductions for any loss in value resulting from unnecessary handling.

10. Returns, Exchanges & Faulty Goods

See our Returns & Refunds Policy for full details. Your statutory rights under the Consumer Rights Act 2015 remain unaffected. If a Product is faulty, you may be entitled to repair, replacement, or refund.

11. Promotions, Discount Codes & Gift Cards

• Promotions and codes are subject to their stated terms and may be withdrawn at any time.
• Only one code per Order unless stated otherwise.
• Gift cards/vouchers (if offered) are non-refundable once purchased, except as required by law.

12. Subscriptions (if offered)

If we offer subscriptions, you authorise recurring charges until you cancel. You can cancel via your account or by emailing us. Cancellations apply to future renewals only.

13. Product Information & Candle Safety

We take care to display colours and descriptions accurately, but variations may occur. Always follow the safety label and care card. Never leave a burning candle unattended; keep away from children, pets, drafts, and flammable materials; trim the wick before each use; burn on a heat-resistant surface.

14. Age Restrictions

You must be 18+ to purchase. We may cancel Orders that we reasonably believe are placed by minors.

15. Accounts & Security

• You are responsible for keeping your login credentials confidential.
• Notify us promptly of any unauthorised use or security breach.

16. Intellectual Property

All content on the Website (including text, graphics, logos, images, and trademarks) is owned by or licensed to us. You may use it for personal, non-commercial purposes only. You may not copy, modify, distribute, or create derivative works without permission.

17. Reviews & User Content

• If you submit reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with our business.
• You promise your content is lawful, accurate, and does not infringe others’ rights.

18. Prohibited Uses

You must not use the Website to:

• Breach any applicable law.
• Send or upload viruses, malware, or harmful code.
• Infringe intellectual property or privacy rights.
• Harass, defame, or abuse others.

19. Our Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law. Subject to that, we are not liable for: (a) loss not caused by our breach; (b) business losses; (c) loss of profit, revenue, data, or goodwill. Our total liability for any loss arising from or in connection with your Order shall not exceed the price paid for the Products.

You agree to indemnify and hold us harmless from claims arising from your breach of these Terms or misuse of the Website, to the extent permitted by law.

21. Events Outside Our Control (Force Majeure)

We are not responsible for failure to perform or delays caused by events outside our reasonable control (e.g., strikes, extreme weather, carrier issues, pandemics).

22. Third-Party Services

We may use third-party providers (e.g., payment processors, couriers). They may have their own terms and privacy policies; please review them.

The Website may contain links to third-party sites. We are not responsible for their content or practices.

24. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date shows the latest version. Changes will not affect Orders already accepted.

25. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.
